Self-Employment Social Security Act 2017 (Act 789).

This Act consisting of 89 articles aims at providing for the social security for self-employed person and for matters connected therewith and applies to any self-employment activity in the industry specified in the First Schedule. In this updated version, the Scheme, initially concerning the self-employed in the Passenger Transportation Sector, has been extended to other sectors, among which (i) good and food transport; (ii) agriculture; (iii) livestock; (iv) forestry; (v) fisheries; (vi) food; (vii) construction; (viii) manufacturing; (ix) hawkers.
Article 4 states that there shall be Self-Employment Social Security Scheme administered by the Organization (as per the Employees Social Security Act 1969). The Scheme provides protection for self-employed insured persons against employment injuries including occupational diseases and accidents during work-related activities arising out of and in the course of his or her self-employment activity including while travelling for the purpose of his or her self-employment activity (art.3). The Social Security Organization Board may establish any committees to advise and assist it in the performance of its functions and in the exercise of its powers. Every self-employed person shall register with and pay contribution to the Organization in the manner as prescribed for every self-employment activity he is carrying out (art.11). In more detail, the insurance shall regard the following (i) occupational diseases; (ii) temporary disablement; (iii) permanent disablement; (iv) dependants benefits; (v) funeral benefits paid to dependants; (vi) medical benefits; (vii) education benefits. The Act provides also for (i) obligation of reporting (art.32); (ii) right of Organization to recover benefit or money; (iii) procedure for requesting the benefit. Article 45 establishes that a fund Self-Employment Social Security Fund, administered and controlled by the Organization. The Minister shall, by notification in the Gazette, constitute a Social Security Tribunal for such State or area (art.58) to decide in respect of the matters listed in article 59.

This Act comes into operation on a date to be appointed by the Minister by notification in the Gazette.
